Terms governing the use of Translia services, including bookings, payments, and user rights.

THE TERMS AND CONDITIONS BELOW SHOULD BE READ BEFORE USING THIS SITE. YOUR USE OF THIS SITE INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.
The site www.translia.co.id and its applications ('Site') are managed by PT. Trans Lia Nusantara, including its subsidiaries and affiliated companies ('We', “Translia”). By accessing and/or using the Site, you acknowledge that you have read and understood, and agree to be bound by the Terms and Conditions set out below ('Terms') and other terms and conditions in relation to the Site, whether expressly stated in these Terms, or those made outside these Terms but provide a reference to these Terms. If you do not agree to be bound by these Terms, you may not access or use any part of the Site. These Terms constitute a legally binding agreement for you as a user (“you” or “User”). You must be at least eighteen (18) years of age to use this Site.
Please note that We can change, modify, add and delete these Terms at any time if necessary to comply with the provisions of the laws and regulations that apply to Us or reflect changes to Our operations, provided that We will make reasonable efforts to provide notification regarding changes to the Terms. You must check the Terms periodically to ensure your compliance with the most current version. By continuing to use this Site after any changes to the Terms, you are deemed to agree and consent to such changes.
If you use one of our other services, then your use of that service is subject to the terms and conditions applicable to that service, which will be provided to you when you use that other service.
SCOPE OF OUR SERVICES
Through the Site, Translia provides an online platform so that you can browse and order various types of vehicles for rent based on the type of service including using the payment methods available in connection with the choice of product or service ("Services"). By making a reservation through the Site, you will be able to reserve and rental vehicle and other transportation. We will provide confirmation of orders or purchases via electronic mail confirmation and/or other available methods. We reserve the right to refuse orders that do not comply with these Terms and applicable laws and regulations.
In providing the Services, to the extent permitted by law, We have the right not to accept any user or order (or in certain cases cancel the order confirmation) at Our sole discretion and for any reason without providing reasons for rejection/rejection/cancellation. Reasons for rejecting a user or order or canceling an order confirmation may include but are not limited to: violation of these Terms, imposition of trade sanctions or economic sanctions by global or national authorities, embargoes, regulatory prohibitions, fraud or theft (or indications or suspicions of fraud or theft ), suspected criminal activity, suspicious orders, users providing inaccurate, false or misleading information, problems with electronic credit card communications, information or transactions, inappropriate behavior, threats, insults, refusal to provide information, practical obstacles, difficulties or communication jams, Actual Errors (further defined below), a history of violations of these Terms or denials, or being placed on any “blacklist” or “watch list” by a government or international organization. The amount charged will be reimbursed without further charges in such cases. Every payment for an order must be made directly to Translia bank account or other payment method at Translia. Unless Translia is required to withhold such payments based on a payment fund control relationship with the relevant Vendor pursuant to a separate agreement applicable to the relevant Vendor, all such payments will become the property of Translia and the amounts will be due and payable to the relevant Vendor when the service to which the payment relates is provided or on other applicable times required by the relevant Vendor. Translia is not responsible for the validity of a reservation, if payment is not made directly to a Translia bank account or Translia payment channel.
CANCELLATION
By making an order, order or reservation via the Site, you accept and agree to the applicable terms and conditions of Translia, including those relating to policies regarding cancellation and/or unavailability, or in relation to your special requests that may be given to Translia, so make sure you Read Translias terms and conditions carefully before you make an order, order or reservation through the Site. Requests will be handled at Translia's discretion, based on availability and other factors. Your special requests may be subject to additional prices and/or fees by the relevant Translia based on the policies and/or conditions of each Translia.
In connection with changes to orders (including but not limited to changes in dates and routes) made by Users, Translia has the right to cancel new orders made through the order change process, if the initial order is no longer valid (including but not limited to, in the event that the ticket has been used or returned).
PRICES AND PROMOTIONS
We may offer lower prices and/or promotions from time to time. Please note that this may require different terms and conditions, for example, regarding booking and refund policies. If there is a promotion given by the Vendor directly, then the rights and authority for the promotion rests entirely with the Vendor and may not apply to orders made through Translia.
ADDITIONAL FEES & REFUNDS
Each price listed on this Site is only available under certain conditions and the price may change depending on various factors such as but not limited to order availability, length of order and/or other factors. Available prices may include additional taxes and other fees but in certain circumstances may not include taxes and other service fees (such as tips fees for tour guides, other facility fees (if any), and other fees arising from the use of services other than Translia services (if any). You agree that you are responsible for verifying the total fees payable and other terms and details when the confirmation email has been sent. You must verify the order in the order sheet, and you can cancel the order at any time before the final confirmation is made . The prices displayed are detailed so you can see the amount you have to pay, any additional costs due to the use of a credit card or interbank fees charged for shipping costs will be charged to you. If there is a shortfall in the amount paid, then Translia can provide notification electronic mail regarding any shortfall in the amount owed by you. In the event that you cancel your order before paying in full any deficiencies, Translia reserves the right to determine whether to refund the amount paid or, subject to applicable laws and regulations, refund the amount minus the costs incurred by Translia as a result of the costs which is not paid for this shortfall. If you have any questions about the Services, you can contact Translia customer service (during customer service operational hours specified by Translia). For any other cancellations, in accordance with applicable law, as well as Translia policy, Translia will first investigate and verify the order before providing a refund in accordance with the amount you have paid, minus costs incurred by Translia, including but not limited to fees administrative fees, interbank transfer fees, credit card fees, etc. Once the order has been successfully verified by Translia, subject to applicable laws and regulations, a refund will be offered to you in the form of cash or electronic vouchers (E.g. coupons, return transfers). Translia will work with you to refund the amount you have paid, less reasonable costs incurred by Translia (for example interbank transfer fees). Refunds may not occur immediately depending on your initial payment method. Refunds may be made via credit card chargeback if this option is available and you request it.
Refunds will be made to the payer's account according to the transfer payment made by you. Refunds for payment transactions using credit cards will be returned to the payer's credit card limit in accordance with the time period determined by each bank You can contact Translia customer service for more details regarding the estimated duration of receiving your refund. Translia will not be responsible for any issuance of e-tickets, e-vouchers, or other transactions that are aborted due to the inaccurate amount transferred by the user or payment not being made via the official payment method available on the Site. Any transfer made beyond the time limit for transfers will result in the order being cancelled. For real-time transfers between banks, you must use an ATM. After completing the interbank transfer, please confirm your payment by filling in the payment confirmation form.
USER ACCOUNT
You must create an account to use the Services. For registration purposes, we will collect and process your personal information, such as your name, electronic mail address (email), and mobile phone number when you register. You must provide us with accurate, complete and up-to-date information and agree to proof of identity that we may request for clear reasons. We will collect, use, disclose and process your personal information in accordance with our available Privacy Policy. Only you have the right to use your own account and you represent and warrant that you will not allow any other party to use your identity or account for any reason, unless permitted by Translia. You cannot transfer or transfer your account to any other party. You must maintain the security and confidentiality of your account password and identification that we provide to you. PAYMENT DETAILS AND PROCEDURES
Payment is made in the amount and currency as stated, excluding bank fees or any other fees charged by Translia. For all forms of reservation, you must make payment before the specified deadline. If payment is not made, Translia has the right to cancel all reservations or abandon the booking process. Payment methods include but are not limited to bank transfer and credit card. For payment via bank transfer, you must provide a bank transfer receipt as proof of payment for the reservation stated in Translia's confirmation email. You must follow the procedures contained in the confirmation email. For other payment methods such as credit cards, you must follow the procedures stated by Translia and/or the relevant payment service provider. Once you have made full payment, Translia will place the order and issue a reservation code, which will be accompanied by:

PAYMENT BY CREDIT CARD & FRAUD
For payment for bookings made through this Site, your credit card will be charged by Translia for the full price at the time of booking and confirmation of the booking (any refund that may be given will depend on the terms of the existing reservation). You should check the booking details thoroughly at all times before you make a reservation. For certain reservations, you may have to pay the Vendor directly. In order to safeguard and encrypt your credit card information when in transit to us, we may use encryption technology such as Transport Layer Security (TLS) or Secure Sockets Layer (SSL) to ensure the integrity of your information. In the event of credit card fraud or misuse of your credit card by a third party, you must immediately contact your bank or card issuer once you become aware of the misuse. In this case, Translia will not be responsible for any incident of credit card fraud or misuse of your credit card by a third party, regardless of whether the fraud or misuse was carried out through Translia services, other than events arising from fraud by or clearly proven to be intentional actions or errors from Translia.
Unless otherwise required by statutory regulations, Translia is not obliged to refund or reimburse you as a result of such fraud. As part of our goodwill, we may provide a form of compensation to you based on our assessment and approval. You will only be eligible to request compensation if the order was made via our secure server and the fraud or misuse of your credit card was the result of our error or negligence and there was no contribution from your own error when using our secure server or by law you are entitled to compensation. We are not responsible for fraud or misuse of your credit card if this is done through an application or server other than ours or if this is the result of your own error or negligence. If you suspect an unauthorized or fraudulent order has been made on Translia, you must immediately contact our customer service team.
To make a reservation, you must be over eighteen (18) years of age and have full legal capacity to make transactions (or have the authority of your legal guardian). You must use a credit or debit card that you own, issued in your name, and ensure that there are sufficient funds to cover transaction costs. Any costs you incur for transaction authorization that result in overdrawn on your account are not Translia's responsibility. You must ensure that the details you provide to us are completely true, correct and accurate. Translia reserves the right not to accept certain credit cards. Translia may add or remove other payment methods at its absolute discretion. In certain cases, We may require additional information or verification to validate and confirm an order, as described in more detail on the Site. Bookings are not confirmed until you have received a confirmation email with an e-ticket or voucher and it is possible that the Vendor may implement fraud checking mechanisms during the booking process. If fraud occurs or is determined to occur, the order will no longer be available or will automatically become invalid. Translia will not have any responsibility. If you choose not to submit additional information, the reservation will not be completed and will become invalid.
RIGHTS AND OBLIGATIONS
Translia hereby grants Users certain limited rights (constituting a 'Limited License'), which cannot be transferred or delegated, to access and use the Site to the extent expressly permitted by these Terms. In connection with this Limited License, We do not grant you any other rights or licenses in connection with the use of the Site; any rights or licenses not expressly granted are solely owned by Translia or other third party owners of such licenses. The content available on the Site, including any information, data, text, images, sounds, graphics, videos, messages, reviews or other materials, including the software infrastructure used to provide the content (“Content”) is solely owned by Translia or its suppliers and its service providers, including but not limited to its Vendors (as applicable). You may use the Site to make reservations and you hereby warrant that you will not submit fraudulent reservation requests. You hereby declare to ensure that the payment information you provide is true and completely accurate. You also guarantee to provide a correct and accurate e-mail address, mailing address and/or your contact details. In connection with the Terms of the Site, you agree not to use the Site or Content for commercial purposes or either directly or indirectly for purposes other than personal use or for unlawful purposes (prohibited by law) or to commit acts that violate these Terms. Except with Translia's written agreement, you agree not to modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell or resell any information, software, products or services obtained in connection with the Site. Translia respects User confidentiality. Translia will endeavor to comply with the requirements of relevant data protection legislation when carrying out its obligations under these Terms. A separate Privacy Policy document sets out the rights and obligations of Translia and users in relation to privacy.
GOVERNING LAW
These Terms (and any and all disputes arising from or in connection with these Terms (including any alleged breach or challenge to the validity or enforceability of these Terms)) will be governed by and interpreted only in accordance with the Laws of the Republic of Indonesia.
DISPUTE RESOLUTION
All disputes arising from or in connection with these Terms and the Services, including any questions regarding validity, or termination, the Parties will resolve by deliberation in good faith to reach a consensus within sixty (60) days from the date of notification of the existence of the dispute.
ETC
The provisions contained in these Terms and any agreements and policies included or referenced in these Terms constitute the entire agreement and understanding between the parties with respect to the Services and the Site and supersede any prior agreements or understandings between the parties with respect thereto. The parties also hereby exclude all implied provisions. When using the Site for or on behalf of a third party, you agree to indemnify and hold harmless Translia from and against any and all liabilities, losses, damages, suits and claims including legal fees, arising from or connected with any violation of these Terms or negligence by You and/or the third party. All forms of damage or losses or claims submitted by third parties related to the Services and/or Site will be resolved based on the provisions contained in these Terms. These provisions are made in Indonesian and English. If there is a conflict between the Indonesian version and the English version, the Indonesian version will apply.
In the event that any provision of these Terms is determined to be unenforceable or invalid, by a court of competent jurisdiction, then such provision will remain enforceable to the fullest extent permitted by applicable law and such determination will not affect the validity and enforceability of any remaining provisions the remaining. Broken provisions should be replaced with provisions that approximate the original wording and intent as much as possible. The failure of either party to enforce any provision of these Terms at any time will not be construed as a waiver of each partys right at a later time to enforce any other term or provision of these Terms unless such provision is waived in writing. You cannot assign or transfer your rights or obligations under these Terms, without our prior written consent. Translia may assign, sublicense or transfer any rights granted to Translia or subcontract any of Translia obligations in providing Services on the Site. Unless otherwise stated, nothing in these Terms is intended to confer on any third party any right to enforce any term or to confer on any third party any benefits under these Terms. Notices given in accordance with these Terms will be deemed to be sufficiently given if made in writing and sent by registered post or recorded delivery service or equivalent to either Party (at Our registered address, or otherwise notified). Translia may provide notice to you via a general notice published on the Site or to your electronic mail address listed in your account. You must give notice to Translia by registered post or registered delivery service or equivalent to one of the Parties (at Our registered address, or notified). By using Our Services, You acknowledge that We may need to comply with additional terms and conditions created by Our suppliers which may apply to certain products. You agree to comply with all applicable laws, statutes, regulations and codes, including any changes (if any), to the transactions you carry out with Translia, including provisions relating to anti-bribery and anti-corruption.
FORCE MAJEURE
Translia will not be responsible for non-performance or violations of these Terms, such as failed transactions, limited access to the Site, or any damage or harm to users caused by any act or condition beyond the reasonable control of either You or Us ( "Force Majeure Event"). Force Majeure events include but are not limited to natural disasters (floods, earthquakes), epidemics, riots, declarations of war, war, military actions, terrorist acts, embargoes, sanctions, changes in laws or regulations, lightning, storms/typhoons/cyclones , labor strikes, demonstrations and bankruptcy. Translia will not be responsible for any damage or loss caused in any way to any party if Translia is unable to process your order due to a Force Majeure Event.
